SAS sniper jailed for gun possession wins appeal

LONDON (AP) ? An elite British sniper jailed for illegally possessing a gun and ammunition won an appeal Thursday to suspend his sentence, after pleading that he forgot about having the gun as a result of a brain injury.

Sgt. Danny Nightingale of the Special Air Service admitted illegal possession of the 9mm Glock pistol and more than 300 rounds of ammunition at a court martial earlier this month. He was sentenced to 18 months military detention on Nov. 7.

Lawyers for the 37-year-old, who has served in Afghanistan and Bosnia, had said that he was given the gun as a present by soldiers he helped train in Iraq and that he had forgotten about it because of a brain injury.

It was not immediately clear what caused the soldier's memory problems.

Nightingale's lawyers said the SAS soldier had no intention to use the ammunition, which was discovered along with the gun in his army quarters. They also pleaded with the Court of Appeal to show mercy to a man who had risked his life serving the country.

More than 100,000 people signed a petition in support of Nightingale after his family launched a campaign to free him.

Three appeal judges ruled Thursday that Nightingale's sentence was too harsh, and that the offenses were committed in "exceptional circumstances by an exceptional soldier."

The 18-month sentence was to be reduced to 12 months and be suspended, they said.

Nightingale was released immediately. The defense ministry said Nightingale is still on active service.

NASA surprised to spot ice on Mercury

NASA's Messenger probe enabled researchers to find unexpected materials frozen in Mercury's north pole. Scientists think the materials arrived via comets or asteroids that hit millions of years ago.?

Despite searing daytime temperatures, Mercury, the planet closest to the sun, has ice and frozen organic materials inside permanently shadowed craters in its north pole,?NASA scientists said on Thursday.

Earth-based telescopes have been compiling evidence for ice on Mercury for 20 years, but the finding of organics was a surprise, say researchers with?NASA's MESSENGER spacecraft, the first probe to orbit Mercury.

Both ice and organic materials, which are similar to tar or coal, were believed to have been delivered millions of years ago by comets and asteroids crashing into the planet.

"It's not something we expected to see, but then of course you realize it kind of makes sense because we see this in other places," such as icy bodies in the outer solar system and in the nuclei of comets, planetary scientist David Paige, with the?University of California, Los Angeles, told Reuters.

Unlike?NASA's Mars rover Curiosity, which will be sampling rocks and soils to look for organic materials directly, the MESSENGER probe bounces?laser?beams, counts particles, measures gamma rays and collects other data remotely from orbit.

The discoveries of ice and organics, painstakingly pieced together for more than a year, are based on computer models, laboratory experiments and deduction, not direct analysis.

"The explanation that seems to fit all the data is that it's organic material," said lead MESSENGER scientist?Sean Solomon, with?Columbia University in New York.

Added Paige, "It's not just a crazy hypothesis. No one has got anything else that seems to fit all the observations better."

Scientists believe the organic material, which is about twice as dark as most of Mercury's surface, was mixed in with comet- or asteroid-delivered ice eons ago.

The ice vaporized, then re-solidified where it was colder, leaving dark deposits on the surface. Radar imagery shows the dark patches subside at the coldest parts of the crater, where ice can exist on the surface.

The areas where the dark patches are seen are not cold enough for surface ice without the overlying layer of what is believed to be organics.

So remote was the idea of organics on Mercury that MESSENGER got a relatively easy pass by?NASA's planetary protection protocols that were established to minimize the chance of contaminating any indigenous life-potential material with hitchhiking microbes from Earth.

Scientists don't believe Mercury is or was suitable for ancient life, but the discovery of organics on an inner planet of the solar system may shed light on how life got started on Earth and how life may evolve on planets beyond the solar system.

"Finding a place in the inner solar system where some of these same ingredients that may have led to life on Earth are preserved for us is really exciting," Paige said.

MESSENGER, which stands for Mercury Surface, Space Environment, Geochemistry and Ranging, is due to complete its two-year mission at Mercury in March.

Scientists are seeking?NASA funding to continue operations for at least part of a third year. The probe will remain in Mercury's orbit until the planet's gravity eventually causes it to crash onto the surface.

Whether the discovery of organics now prompts?NASA to select a crash zone rather than leave it up to chance remains to be seen. Microbes that may have hitched a ride on MESSENGER likely have been killed off by the harsh?radiation?environment at Mercury.

The research is published in this week's edition of the journal Science.

Ricky Martin: Puerto Rico Needs A ?Serious' Statehood Plebiscite

At a time when statehood supporters in Puerto Rico are seeing new allies pop up in states like Ohio, helping to push their agenda in front of the U.S. Congress, one of island's best-known, Ricky Martin, is calling for a democratic movement that truly represents Puerto Ricans.

The singer and actor in the recent Broadway musical "Evita" says he's convinced the last referendum election doesn't reflect public sentiment.

?It is so mixed," the Puerto Rican star told The Huffington Post Thursday night during a meeting with reporters in his dressing room. "It is apparent but is not. I think democracy must be respected. We must have a plebiscite, a serious plebiscite, where a simple question of 'Yes' or 'No' is answered.?

In the second question of a two-part, non-binding referendum on Nov. 6, Puerto Ricans were asked if they wanted to become a state, an independent country or a freely associated sovereign state. A majority of those who answered the question favored statehood, but some 480,000 voters cast blank ballots -- presumably because they favored remaining a commonwealth. If the blank ballots are counted, statehood only won 45 percent of the vote. Many people have criticized the vote because there were so many abstentions.

?Us Puerto Ricans must go and practice our democracy and let our voice be heard, and then bring it to the Congress of the United States,? Martin added, voicing his criticism of the referendum.

But he clarified that his opinion is not political, but is instead about a personal concern regarding the transparency of the election process in the U.S. territory.

?Right now it's very confusing. I am not going to say what I am up for, I am just going to say that this is a serious matter and we must be serious about a good healthy plebiscite,? Martin said.

The artist has become a prominent celebrity human rights defender. Currently, he manages the Ricky Martin Foundation, fighting against sexual exploitation, and he is now the lead spokesperson for Viva Glam, an initiative created by the makeup house MAC Cosmetics, raising awareness and funds for HIV/AIDS victims.

The actor is also in the middle of a career transition, recently announcing his plans to become a judge in the Australian edition of the upcoming TV talent reality show ?The Voice," early next year.

But these commitments don't prevent him from being politically active. Martin worked for President Barack Obama's re-election campaign and the singer is optimistic that the next four years will bring new hope for Latinos.

?The re-election of our president for me was nothing but light. I'm sorry, but it was really scary if it went the other way, it was going to be like going back in time,? Martin said. ?As a Latino Puerto Rican U.S. citizen that can vote for the president, it was very beautiful to see minorities getting together for democracy, for freedom, for civil rights. We are part of this country and we move this country as well. We have a voice. And apparently we were very loud.?

Josue Molina, Brother Of Boy Killed In Crash: 'I Wished Nobody Invented The Bus, So He Would Still Be Alive'

The panicked stepfather, wielding a sledgehammer, smashed out the window of the bedroom where one child was screaming and another lay dying.

Both boys had been trapped in the wreckage after a transit bus crashed through the front of their Hempstead Village home Tuesday night, the family recalled Wednesday.

"Papi! Papi! Mommy! My brother!" 7-year-old Josue Molina yelled moments later, said his stepfather, Santos Herrera, 41.

Josue, clad in a SpongeBob SquarePants pajama shirt and Batman bottoms, frantically dug through the rubble, trying in vain to save his younger brother, David Granados, 6.

"I was pulling on the rocks -- pulling and pulling -- but I couldn't find him," Josue said while his parents grieved with him nearby.

"I wished nobody invented the bus, so he would still be alive," the second-grader said.

Herrera, unable to open the bedroom door, climbed through the window but could rescue only Josue.

The younger boy was pronounced dead about an hour later at Winthrop-University Hospital in Mineola, his parents by his side.

As the Nassau Inter-County Express bus carrying 11 passengers ran its doomed route shortly after 9 p.m., the boys were getting ready for bed in their shared room.

"We were chatting a little bit," Josue recalled. "I was in bed already."

David had almost finished changing into a Transformers shirt and rocket ship pajama pants. The unremarkable bedroom routine ended in an instant, when Josue looked out the window and saw the bus coming right at him.

"I was awake when the bus came," he said. "It was out of control."

In the kitchen, Mari Bel Molina was making school lunches for her sons, said Alida Gutierrez, 36, who lives in another rental unit in the house.

Molina and Herrera, a cook at an Italian restaurant, had been having a late dinner of Spanish eggs and shrimp, he said.

The bus hit the two-story house with a thunderous boom. The driver had swerved to avoid a jaywalker on Fulton Avenue near Nassau Place and jumped the curb, police said.

Herrera ran to the boys.

"The children, they were trapped in the room," he said, speaking through a Spanish translator. "I went through the window. Everything was blocked."

Miraculously, Josue suffered only scrapes on his arms -- cuts he said he got going through the broken window.

When Molina couldn't find the 6-year-old, she sobbed and called out his name, "David! David!" Gutierrez said.

But, as Molina said Wednesday before retreating to her bedroom, "It was too late."

Josue, wrapped in his parents' arms, called his brother his "best friend ever -- until the bus came.

"I love him a lot. . . . I want him now. I'm sad that he died."

He said he and David often played tag, hide-and-seek and Nintendo DS video games. He said his brother's favorite color was orange, and noted David's fondness for bananas -- sometimes.

"We do our homework together every day," he said. "I help my brother go figure out every answer. I even teached him how to do pluses and take-aways. I told him how to do times, too."

Wednesday, a team of officials and psychologists from the Hempstead school district visited the apartment in Garden City Park where the family is now staying.

The parents are struggling with how best to help their surviving son cope. For now, they are all dealing with their grief by shedding tears, they said.

"He says he wanted another brother because his brother died," Herrera said as he packed a suitcase in their wrecked home.

As the family makes funeral plans, Josue promised never to forget David.

"He's in the sky right now, just watching," Josue said.

"I'm going to miss him a lot. But he's always going to be in here."

The boy pointed to his heart.

"He'll be with me in my dreams." ___

Roland Dow, Jessica Linscott Arrested At Theme Park Parade For Alleged Child Abuse After Two Weeks On Run

A New Hampshire couple suspected of abusing the woman's 3-year-old son have been arrested while leaving a parade at a theme park in Orlando, Fla., after two weeks on the run, authorities say.

Jessica Linscott and her boyfriend, Roland Dow, were taken into custody on Wednesday evening at Universal Studios, where they had been watching the parade, U.S. marshals said.

Linscott, 23, and Dow, 27, were wanted in connection with injuries to Linscott's son, including burns and significant head injuries.

Police had received a call two weeks ago from Exeter Hospital, in Exeter, N.H., where the boy was being treated. The boy later was taken to Children's Hospital at Dartmouth in Lebanon, N.H., where he was recovering after surgery.

Tips helped to track down the couple, Rockingham County Attorney Jim Reams said.

"We were feeling pretty confident 24 hours ago that we were going to have them soon," Reams said Wednesday.

Law enforcement officials spent "countless hours" trying to find Linscott and Dow, who are from Plaistow, N.H., a town of about 8,000 residents in Rockingham County, marshals said.

Marshals looked for the couple all day Wednesday and at the end of the day found them while a crowd was breaking up after the parade and they were headed back to the theme park's attractions area, said David Charles, deputy criminal investigator for the U.S. Marshals Service in Orlando.

"They were totally surprised," he said. "They had no clue."

U.S. Marshal David L. Cargill Jr., who thanked the public for providing tips during the search for the couple, said he found it "very sad" that they were found in an area "designed to bring joy and happiness to children."

Linscott is accused of failing to get medical attention for her son when he was suffering seizures from a head injury and of failing to protect him from harm. She's charged with multiple counts of child endangerment.

Dow is charged with assault.

Linscott and Dow were jailed on Wednesday and couldn't be reached for comment by telephone. They were scheduled to be arraigned in Florida on Thursday on fugitive from justice charges.

White House, Congress talk as 'fiscal cliff' nears

WASHINGTON (AP) ? Amid increasing anxiety that the White House and top Republicans are wasting time as the government slides toward an economy-rattling "fiscal cliff," administration officials are heading to Capitol Hill for talks with congressional leaders.

Treasury Secretary Tim Geithner and senior White House aide Rob Nabors were to visit separately Thursday with the four leaders of the House and Senate to discuss how to avert a series of tax increases and spending cuts due to begin in January. Republicans complain that the White House is slow-walking the talks and has yet to provide specifics on how President Barack Obama would curb the rapid growth of benefit programs like Medicare and Medicaid.

Obama and House Speaker John Boehner of Ohio, the lead GOP negotiator, spoke on the phone Wednesday, their first conversation in five days. But there's been little evident progress in negotiations between the two sides.

Boehner's lieutenants say the White House has been slow to engage.

"We have not seen any good-faith effort on the part of this administration to talk about the real problem that we're trying to fix," said House Majority Leader Eric Cantor, R-Va.

Obama is mounting a public campaign to build support and leverage in the negotiations, appearing at the White House with middle-class taxpayers and launching a campaign on Twitter to bolster his position.

"Right now, as we speak, Congress can pass a law that would prevent a tax hike on the first $250,000 of everybody's income," Obama said. "And that means that 98 percent of Americans and 97 percent of small businesses wouldn't see their income taxes go up by a single dime."

Obama is insisting that tax rates go up on family income exceeding $250,000; Boehner is adamant that any new tax revenues come from overhauling the tax code, clearing out tax breaks and lowering rates for all.

Republicans are also demanding significant cuts to so-called entitlement programs like Medicare, such as an increase in the eligibility age for the program from 65 to perhaps 67.

"It's time for the president and Democrats to get serious about the spending problem that our country has," Boehner said at a news conference Wednesday in the Capitol. Boehner, like Obama, expressed optimism that a deal could be reached.

At issue are steep, across-the-board cuts to the Pentagon and domestic programs set to strike the economy in January as well as the expiration of Bush-era tax cuts on income, investments, married couples and families with children. That combination of tax increases and spending cuts would wring more than half a trillion dollars from the economy in the first nine months of next year, according to the Congressional Budget Office.

No one anticipates a stalemate lasting that long, but many experts worry that even allowing the spending cuts and tax increases for a relatively brief period could rattle financial markets.

From their public statements, Obama and Boehner appear at an impasse over raising the two top tax rates from 33 percent and 35 percent to 36 percent and 39.6 percent. Democrats seem confident that Boehner ultimately will have to crumble, but Obama has a lot at stake as well, including a clear agenda for priorities like an overhaul of the nation's immigration laws.

Investing as a Group

On

Real Estate = Big MoneyInvesting on your own may prove difficult, especially if you don?t have the funds to make your investment dreams come to fruition. However, investing as a group, whether buying shares, investing in property or learning how to trade forex, gives you greater buying power and more potential to achieve successful returns.

Investment Clubs

(i) The Perks

An investment club is most likely the best option for new investors looking to invest their worth alongside others. Investment clubs are ideal for some investors, particularly because they have the ability to:

  • Allow a greater buying power.
  • Increase education for members and give them a chance to learn about the market.
  • Give new members high-end, real-world experience in the marketplace.
  • Bring in higher returns.
  • Lower fees and expenses by splitting costs between all members.
  • Give members the chance to share thoughts and ideas about investing.

(ii) The Downside?

However, one of the main drawbacks to joining an investment club is that many of these clubs can be operated by scam artists. These people set up the investment club with the sole purpose of enticing investors and then stealing all their money.

When searching for and joining an investing club, make sure that you do so by reputable means. Find out as much as you can about the club before you join and be wary of direct offers to join any clubs, even if the offer has been made by someone you trust.

A trustworthy club should have strong goals and investment strategies, solid rules and regulations, a set structure and should present the right paperwork and certifications.

Shared Goals and Values

It?s important in investing as a group that you all share common goals, ideals and values. If not, this can lead to much conflict within the group, and subsequently, certain members can try to take control. Regulations and rules should also be in place (particularly in regards to when to sell and buy commodities or shares), and any monetary values (whether fees or profits) should be equally shared amongst all the members.

Evaluate your long-term goals, strategies and approaches to investing and consider how your group can work together to leverage your investment success.

Plan Long-Term Investments

According to some sources, the trend of investment groups and clubs often follows the potential for high returns in a fluctuating market. When times are good, groups flourish; however, 12 months later, when prices have fallen, the groups fail and disband.

The key to investing successfully as a group is to select a group (or start a group and select members) who are serious investors committed to long-term goals.

Investors who are looking to make a profit within the next 1-2 years are probably not earnest about their investing. Instead, all members should be passionate about investing and keen to share knowledge about the marketplace, with a realistic vision of investing over a numberofyears.

iCloud and the problem with opaque sync

iCloud was meant to make data ubiquitous -- to magically handle syncing everything that really needs syncing between iOS and OS X devices, so users simply have the most up-to-date stuff, backed up and available, all the time and everywhere, without worrying. And it is. Except when it isn't. And when it isn't, it's almost as opaque to developers building against its APIs as it is to users wondering where their stuff is. So what to do?

Tapbots' Paul Haddad spoke about the challenges of iCloud sync, especially document sync, on this week's episode of the Debug show. Other developers, however, have already chosen to leave iCloud behind. Vemedio have chosen to do just that with the upcoming Instacast 3.

[iCloud sync is] gone, thank god. Making iCloud reliable is nearly impossible for a 3rd party developer. The app APIs are confusing, unclear and unreliable. There were so many problems on so many levels that we decided to roll out our own sync solution. If something now does not work correctly, we at least have the possibility to fix it ourselves. Another advantage is that the new sync is much faster and works instantly, at least when both devices are on the same local network.

Developer Steve Streza outlines some of the concerns on Informal Protocol:

iCloud?s biggest problem is that it goes out of its way to obscure a lot of this detail from you. Their pitch is that creating apps with the document system and putting them in iCloud means they will all sync magically and you don?t have to worry and we?ll handle it for you thank you very much. But the reality of syncing data is that it?s tough, and network availability is not always reliable or fast (especially on mobile). You have to write a lot of nonobvious code to handle updates and problems. Building for iCloud once means you limit yourself to only Apple devices; you can never get that data synced to an Android device or make it accessible via the web (short of later building your own system, updating your apps, and making them push iCloud-stored data to your own server). And iCloud has not exactly gained notoriety for its stability or its friendliness to developers. The only real debugging tools you have are a web app that lets you see what?s in an iCloud folder and some rather verbose logging flags you can turn on that tell you some stuff about the syncing process. In other words, it?s not easy. I?ve tried to integrate iCloud no less than 6 times in various app prototypes, and every single time I?ve ran from it.

Streza does point out, however, how hard rolling your own solution can be. That's true if you're an indie developer, and just as true if you're Apple. Google, Amazon, and Facebook are internet services companies. Apple isn't. They're having to become one, and you don't pivot from software to services on a dime.

iCloud is still a work in progress, and it will likely continue to improve in future iOS and OS X versions. Hopefully it'll continue to improve independent of iOS and OS X as well, as the advantage of server side services should include decoupled development and hardware that's capable of receiving updates when they're ready, irrespective of the state of client-side OS updates.

The cloud in general, and its increasing importance in every day computing, continues to be a huge challenge for Apple, and one they absolutely have to nail. Fortunately, even their strongest cloud competitors, like Google, are still falling on their faces every once and a while. But time isn't on Apple's side here.

Let's hope everyone in Eddy Cue's internet services division is working on making iCloud and related server-side infrastructure not only ubiquitous, but far more modern, reliable, and scalable for users and developers alike.

Syria rebel bombing kills ruling party official

BEIRUT (AP) ? Syrian rebels bombed the house of a top member of the country's ruling Baath party in the south on Thursday, killing him and his three body guards, activists said.

The bombing took place in Daraa, where the uprising against President Bashar Assad began in March 2011. Since then, rebels have targeted regime figures and military commanders in the capital, Damascus, and in other places around the country.

The increasing frequency of bombings, a hallmark of Islamic extremists like al-Qaida, has led to concerns about the growing role of Islamist militants in the civil war.

Early Thursday, rebels detonated a car bomb near the house of Hussein Rifai in Daraa, the Britain-based Syrian Observatory for Human Rights said, killing Rifai and his bodyguards. The Observatory relies on reports from activists on the ground.

Syria state-run SANA news agency reported the bombing in Daraa. It said there were casualties in the blast, but did not say if Rafai was among those killed.

The bombing in Daraa came a day after twin suicide car bombs ripped through a Damascus suburb minutes apart, killing at least 34 people and wounding more than 80 others.

Damascus, the seat of Assad's power, has been the scene of scores of car bombs and mortar attacks targeting state security institutions and troops, areas with homes of wealthy Syrians, army officers, security officials and other members of the regime.

In May, two suicide car bombers blew themselves up outside a military intelligence building in Damascus, killing at least 55 people. In July, a bomb hit a building in which Cabinet ministers and senior security officials were meeting, killing the defense minister and his deputy, who was Assad's brother-in-law. A former defense minister also died in the attack.

The revolt in Syria started as peaceful protests but turned into a civil war after brutal crackdowns on dissent by Assad's forces. Activists say more than 40,000 people have been killed.

Also Thursday, activists reported heavy fighting between rebels and regime troops in the northern Idlib province.

Government warplanes struck the rebellious districts around Damascus, including the suburb of Daraya where fighting has raged for days, as rebels fight their way into the capital, the Observatory said.

Daraya, which has a population of about 200,000, is part of Rural Damascus, a province that includes the capital's suburbs and adjoining farmland. The area has been a stronghold of support for the rebels since the start of the uprising, posing a significant threat to Assad.

US budget impasse hurts markets

LONDON (AP) ? Lack of progress in negotiations for a deal to avoid a U.S. budget crisis before a January deadline sent world stock markets lower on Wednesday.

President Barack Obama and U.S. lawmakers have until Jan. 1 to reach a deal to trim the country's unwieldy deficit. Otherwise, a series of automatic tax increases and sharp spending cuts will take effect that could drag the world's No. 1 economy into recession.

A high-ranking member of the U.S. Senate unnerved investors and sent Wall Street lower on Tuesday after expressing frustration over the budget impasse and the looming "fiscal cliff."

In early European trading, Britain's FTSE 100 fell 0.5 percent to 5,772.48 while Germany's DAX lost 0.4 percent to 7,300.05. France's CAC-40 fell 0.1 percent to 3,499.44.

Wall Street opened lower, with the Dow falling 0.1 percent to 12,864 and the S&P 500 shedding 0.2 percent to 1,395.63.

Stock market losses began earlier in Asia. Japan's Nikkei 225 index fell 1.2 percent to close at 9,308.35, a day after closing at a seven-month high.

Obama plans to make a public case this week for his strategy as he pressures opposing lawmakers to allow tax increases on the wealthy while extending tax cuts for families earning $250,000 or less.

On Wall Street, reports released Tuesday showing increases in U.S. consumer confidence and orders for machinery and equipment failed to boost stocks significantly.

"If one could just take politicians and the fiscal cliff out of the picture, an optimistic outlook would be far easier to cobble together. There's been depressingly little news of cliff breakthroughs, or even developments, of late," said analysts at DBS Bank Ltd. in Singapore in an email commentary.

In Europe, sentiment improved this week after Greece's bailout creditors agreed to pay its next installment of loans and outlined a series of measures to lower its debt load over the coming decade. Concerns remain, however, over the country's economy, which is expected to enter a sixth year of recession in 2013 and the government's ability to implement its reforms.

In Spain, another hotspot in Europe's crisis, EU authorities on Wednesday approved the payout of ?37 billion in rescue loans to four banks, but only if they cut their assets by 60 percent.

Elsewhere, South Korea's Kospi shed 0.7 percent to 1,912.78 and Australia's S&P/ASX 200 lost 0.2 percent to 4,447.30. Hong Kong's Hang Seng fell 0.6 percent to 21,708.98.

Mainland China's Shanghai Composite Index fell 0.9 percent to 1,973.52, a four-year low. The smaller Shenzhen Composite Index tumbled 1.9 percent to 750.97.

Benchmark oil for January delivery was down $1.17 to $86.01 per barrel in electronic trading on the New York Mercantile Exchange. The contract fell 56 cents to finish at $87.18 per barrel on the Nymex on Tuesday.

In currencies, the euro fell to $1.2919 from $1.2939 on Tuesday in New York. The dollar fell to 81.89 yen from 82.17 yen.

Will a Probe of California Oil Refineries Prove Market Manipulation?

Relying on a Nov. 15 McCullough Research report, six senators from the West Coast are calling on the Department of Justice (DOJ) to launch a "refinery-by-refinery probe," a press release by Senator Dianne Feinstein notes. Allegations suggest that the 66-cent per gallon of gasoline price increase yielded a $25-million a day profit for oil companies. "The difference between what drivers actually paid and what they should have paid exceeded $1 billion," the senators claim.

Oct. 5: California Gasoline Prices Jump by 20 Cents to 40 Cents per Gallon

The Associated Press reported that the average price for a gallon of regular gasoline reached $4.49. Southern California and the Bay Area were hit particularly hard, with some gas stations charging $4.54 or $4.60 for a gallon of gas. Fuel retailers note that refinery problems had contributed to the shortages.

Oct. 7: California Governor Considers Early Release of Winter-blend Fuel

The State of California requires the use of a specifically formulated summer blend to be sold at the pump until Oct. 31. CBS Los Angeles and the Associated Press reported that Gov. Jerry Brown discussed an early switch to the more readily available winter blend with operating refineries. By this time, gasoline prices had climbed to an average of $4.70 in Los Angeles. Statewide, the average price for a gallon of regular gasoline had increased to $4.65, which surpassed the previous high mark of $4.60 in June 2008. Responsibility for the sudden spike in gasoline prices was apportioned to a Southern California refinery suffering a Monday power outage.

Nov. 5: Gasoline Drops below $4 per Gallon

The Los Angeles Times noted that the statewide average cost for a gallon of regular gasoline reached $3.97. Nevertheless, the cost of gasoline was still more than 13 cents above the price charged in November 2011. California energy experts "blamed the spike on low gasoline supplies, low fuel production, a year of numerous refinery outages and exports of fuel to overseas customers."

Nov. 21: Gas Priced Fell by almost 90 Cents

Just before Thanksgiving, California gasoline prices averaged $3.77, the L.A. Times reported. This represented another 6.9-cent drop compared to the week before. The Los Angeles area saw gasoline prices of $3.82 cents per gallon, which was lower than the Central Coast region where the cost still reached $3.89.

Nov. 27: Six West Coast Senators Call for DOJ Probe into "Possible Market Manipulation and False Reporting by Oil Refineries"

The New Guard pinpoints the Exxon Mobile refinery in Torrance as the causation for the spike in gasoline prices that had affected California and indeed the West Coast. Sen. Dianne Feinstein, D-Calif., joined with Sens. Maria Cantwell, D-Wash., Ron Wyden, D-Ore., Patty Murray, D-Wash., Barbara Boxer, D-Calif., and Jeff Merkley, D-Ore., in calling for a DOJ investigation, Feinstein's press release notes.

"We are requesting a Department of Justice investigation of possible market manipulation and false reporting by oil refineries which may have created a perception of a supply shortage, when in fact refineries were still producing," the senators said.

Sylvia Cochran is a Los Angeles area resident with a firm finger on the pulse of California politics. Talk radio junkie, community volunteer and politically independent, she scrutinizes the good and the bad from both sides of the political aisle.

Rhino killings not slowing in South Africa

VAALKOP DAM NATURE RESERVE, South Africa (AP) ? South Africa says at least 588 rhinos have been killed by poachers this year alone, the worst recorded year in decades.

The nation's Department of Environmental Affairs says most of the killings occur in South Africa's Kruger National Park, a region of about 19,400 square kilometers (7,500 square miles) in the country's northeast.

From the 1990s to 2007, rhino killings in South Africa by poachers averaged about 15 a year. However, the number has soared as buyers in Asia pay the U.S. street value of cocaine for rhino horn.

Rhino horn is made of keratin, a tough protein found in human fingernails. There's a belief in Asia that taking ground-up horn cures diseases. However, no medical evidence supports that.

3 Tips on Self-Love & Relationship Readiness

By?J. Cameron Gantt

When it comes to?love?and?relationships, the fabulous Earth Kitt once said ?It?s all about falling in love with yourself and sharing that love with someone who appreciates you, rather than looking for love to compensate for a self-love deficit.?

These are some of the things that keep many singles on what I like to call a ?hamster wheel? of bad relationships and it all stems from not being comfortable in your own skin. We all crave companionship in some form and we all deserve to a shot at finding love but the truth is, until you can master the art of?loving yourself, you will never be able to love or accept love from anyone else.

Luckily, it?s never too late to start nurturing the relationship you have with yourself and it?s never too late to start using that energy to attract a healthy, authentic and fulfilling relationship with someone else.

Be Honest
If you can?t be honest with yourself, how can you be honest with others? Honesty is important for any genuine relationship, especially the one we have with ourselves. Sometimes, I think that we forget to separate the fantasy of what we want from the reality of what we need. As a result, we find ourselves lost, confused and sometimes desperate looking for a way out. This is the point where people usually find themselves stuck because instead of focusing on the root of the problem, they are focusing on the quick fix.

The truth can be scary, but you have to take the good with the bad and own it. If it?s a positive truth, then live by it. If it?s a negative truth, then you have the option of either working towards changing it or working towards accepting it.

This honesty will bring you clarity within yourself and will also allow you to be more honest and clear about what you need in a relationship.

Stop, Look and Listen!
Pay attention to your actions and reactions. It easy for us to get distracted with responsibilities and find ourselves stuck on autopilot. A lot of times, I find that people get caught up taking on responsibilities and emotions that really serve them no purpose. It?s wasted energy.

Everything you do should serve your purpose. If you find yourself in a place where you feel like you are just going through the motions, take a time out to stop and reevaluate things. No matter how big or small the task at hand or how major or minor the info you are receiving, ask yourself: How will my actions or reaction to this situation serve my purpose?

Eliminate The Negative Self-Talk
We all have our good days and bad days and sometimes, insecurities can get the better of us. It would be unrealistic to say that you should never have a bad day ever. It just doesn?t work that way and anyone who says that they are 100% confident all the time has a good poker face.

A lot of confidence issues stem from comparisons we make between ourselves and the lives of those we know. Those comparisons are reinforced with negative self-talk and that talk is what tricks us into thinking that we are not good enough.

When you find yourself lost in a sea of negative self-talk, just replace it with positive talk. Look at your accomplishments, big or small, and celebrate them. If something is really bothering you, transform that bad juju into productive energy and get to work on changing that situation.

When you do get into a relationship, you will be better equipped to?love?that person, flaws and all.

Creativity and Affect | Self Improvement & Personal Growth ... - David ...

Creativity and Affect

The authors of this volume attempt to cohere the field of creativity and affect in a scholarly fashion by categorizing and characterizing some of its major features, including environmental influences; underlying processes; specific affective states; the role of atypical or pathological personalities; unconscious processes; physiological components; proactive and reactive stimuli; intrinsic motivation; eminence versus everyday creativity; and testing of assessing the affective component of creativity. The authors also examine and discuss the role that emotions, feelings and moods play in the creative process. This volume also provides a vehicle for students and psychotherapists, with which they can fully appreciate the feelings generated by the creative process and the various stages of it. How does a creator feel during its more mundane phases? Can he or she tolerate the frustration of failing and being unsuccessful most of the time? What is the real joy of achievement, success, and ultimate acceptance by ones peers in a given field? Do we have to exhibit major psychopathological features in order to achieve eminence in specific fields? What is the role of mind altering substances, mood disorders, and the like? This volume answers these questions and more. Author: Shaw, Melvin P./ Runco, Mark A./ Shaw, Melvin P. The trouble with education in Nigeria ? The Punch - Nigeria's Most ...

Pat Utomi

Every day, it seems, these days, I am telling one group or the other that leadership is other -? centred behaviour. Obsession with self, the prevalent narcissism, I say often, is part of the reason we have a dearth of leaders. So, is there a select group of the altruistic from whose ranks true leaders can emerge? Not at all, to my mind. Service to others is not masochism or less love for self. Indeed for the really enlightened, it is the highest form of selfishness.

Does this sound like a confusing paradox? Not at all. Think of this. Two Governors start out. One of them just keeps thinking of No 1 because, as he read in one of Chinua Achebe?s works, the person who has escaped the rain into shelter does not want to get back there. So, determined to assure his future, after this temporary stay in public office, he abuses public trust with recklessness, piling up material goods abroad to take care of the rainy day. He does not want to imagine a time in old age when he cannot afford medical care and current wisdom is that medical care is better taken care of abroad.

The other, a very selfish Governor, knows many who lost their lives in accidents and is so protective of his good health he decides to spend money on good roads and builds a world class Trauma Hospital. The inevitable happens after they leave office. They are both in road mishaps. The first Governor, given his chunk of wealth abroad, can afford an air ambulance evacuation and it is all quickly activated. But as we know from the case of one former minister of works who also served as Military Governor, he did not make it to the hospital abroad. The other governor who left office with no savings but had done the roads and built a trauma centre is saved in the surgery of the Theatre he inaugurated. Who was more selfish?

My reference to other ? centred behaviour as the heart of the leadership phenomenon is really self interest defined in an enlightened manner. The enlightened self-interest as living selfishness in deferred gratification is a concept I have long argued needs to enter school curriculum very early. This is one part of an array of soft skills that can drive up the quality of life in our country if education planners are ready for completely rethinking education in Nigeria. I find so often that many people who have the energy, know ? how and know ? why of their specialties are unable to get the cooperation of others to work together to solve problems that challenge us in community. There is emerging a number of initiatives on finishing schools aimed at helping bridge social skills gaps but more needs to be done to fill so many gaps that reduce our effectiveness.

Just as these missing skills are debilitating of leadership so does the problem of an unreliable self-seeking, low morale, poor soft-skilled civil service.

Everywhere in Nigeria, politicians are being called names for failure to deliver. Often, it is deserved because of the absence of a clear vision and passion that can bring out the best in stakeholders. The truth, however, is that even with the best of intentions politicians will have difficulty delivering. The capacity situation in the civil service, across the country, is a frightening national emergency. Unless we deal with this urgently, the story may not change.

Nigeria is hurting because the educational system much praised in the early 1960s had gone South as Sir Eric Ashby said to Prof. Akinkugbe at Oxford just before Ashby?s death. Finding creative ways of bridging these gaps is of utmost importance if we are to save the future.

Right now, we say these challenges to execution of projects happen because of a corrupt civil service. I have given enough thought to the fact that a misconception of self love is responsible partly because these civil servants do not realise that abuse of the system for self-aggrandisement ultimately hurts them more. The ultimate gift would be to teach them to so know.

Xbox Creator: It's Hard For Sony, Nintendo & Microsoft to Ignore The ...

Ed Fries, co-creator of Microsoft?s Xbox gaming console, believes it is harder for gaming platform makers Sony, Nintendo and Microsoft to ignore the gaming and app experience that Apple has created, highlighting the iPhone and iPad maker?s creation of a platform that is easy to develop for and affordable for gamers.

In an interview with GameInformer, Fries ? who is now an advisor for the Kickstarter-funded Android gaming console Ouya?? speaks at length about how the console market still has needs that haven?t been met, that there?s a opening for an ?open console that?s digitally distributed, and it?s just not there.?

While Apple hasn?t invested in today?s console market (yet), Fries is mindful of the effect the company has had on it in the last decade, noting that it?s ?getting harder and harder for the traditional consoles to ignore the Apple kind of experience.?

By this, he means that anyone is able to develop for the platform (developers are not blocked by prohibitively expensive certification processes) and that it can cost nothing for a game to be played, let alone updated.

Fries explains:

Now, you?ve got guys who make games like Fez who can?t do an update to their game because it costs too much, if that game was on iOS that wouldn?t be a problem, but because it?s on XBLA it?s a problem.?Those kinds of ideas have to go away in the next generation. They?ll go away in Ouya, they?ll go away if Apple brings some kind of product into this space, the console makers like Sony, Nintendo, Microsoft, they have to respond to that, it?s just the future.

Likewise they have to respond to the free-to-play game model, the world is changing, people want this free-to-play experience, game developers want to build free-to-play experiences and the console ecosystem has to adapt to that. It can?t just be $50 product in a box all the time.

The former Microsoft executive refers to the costs associated with updating existing titles on consoles, most notably on Xbox Live Arcade. Back in February, we reported on the hoops that console game developers have to jump through in order to roll out important changes like patching and supporting their games.

Tim Schafer, the man behind Psyschonauts, said that Microsoft charges $40,000 to put up a patch, something that smaller studios and teams might not have when it comes to ensuring their XBLA games are 100 percent playable.

Microsoft has its reasons: it?s?a?strategy?that it employs to ensure that it doesn?t find itself constantly fighting to patch hundreds of game updates, but also that it means developers make their titles as bug-free as possible before launch.

Either way, the Apple (and soon Ouya) experience is set to change that. Fries believes that Apple?s model isn?t the answer to all of the console makers problems, but acceptance and adaptability may play a key role in the success of next-generation consoles and gaming platforms.

OC Sheriff Announces That She's Battling Breast Cancer ? CBS Los ...

SANTA ANA (CBSLA.com) ? Orange County Sheriff Sandra Hutchens announced that she has breast cancer and will continue to work, even as she undergoes chemotherapy treatment.

At a news conference Monday, Hutchens said she was diagnosed earlier this month and doctors said her cancer was curable.

?I really believe it was caught early,? Hutchens said. ?Here?s an important message for women ? and for men, men also get breast cancer ? I had a mammogram six months ago and they found nothing, everything was fine. I found this through self-examination. I went to the doctor immediately and I had it diagnosed.?

Hutchens said she has no family history of cancer and does not smoke.

She has already undergone her first round of chemotherapy. The treatment is expected to last six to eight months.

Given that chemotherapy causes hair loss, the sheriff went on to joke that she?ll probably look good in a wig.

Hutchens said she would step back on speaking engagements but would still be able to lead.

?I?m going to be in charge, thanks to iPads, iPhones? I haven?t not been in charge since this, and I don?t plan on it. I will tell you this, I will tell the public this: If, at any time, I felt that I could not carry out my duties I would make other arrangements,? Hutchens said.

Several of her colleagues voiced their support at the news conference.

?She has proven to be a courageous leader for us, a strong leader in our organization, and we?re here to offer 100 percent support for her,? O.C. Assistant Sheriff Lee Trujillo said.

?The first thing that came to my mind is here?s just another opportunity for her to mentor women, not just in this county but all over. She?s a fighter and she?s going to do very well,? Commander Linda Solorza of the O.C. Sheriff?s Department said.

Hutchens was elected Orange County?s first female sheriff in 2008. She leads 3,600 sworn and professional staff members. Her department has jurisdiction over 12 contract cities and unincorporated areas, where nearly three-quarters of a million residents live.

?The reports of my demise have been greatly exaggerated, I?ll tell you that,? said Hutchens, who seemed optimistic Monday, even going on to say that she plans on running for a second term as sheriff in 2014.

Beware of Diet Pills : Ideas For Women Health and Fitness Blog

There are a number of diet pills and diet supplements that promise the world, meaning they promise good moods while you shed the pounds. They promise that you don?t need to watch what you eat, you don?t need to exercise, and you don?t need to count calories. But do these diet pills really work?

This is what you need to know. First, research and look for the real answers, the real clinical studies, and the real opinion of your doctor before trying any magic diet pill. Second, read the label. What does the pill actually contain? Many diet pills may state they are natural or all natural but they may include caffeine or other ingredients that may make your heart race or give you a feeling of anxiety or the feeling of palpitations.

After researching, reading the labels and discussing this with your doctor, the final thing you need to do before taking any diet pill is this. Understand that weight doesn?t just melt off. It takes work. It takes sacrifice. And it may even take EXERCISE.? The more you eat or put into your body the more you have to move to burn those calories, regardless of what diet pill you decide to take.

In defense of diet pills, there are some that really do bind with fats and help your body to excrete it. There are some diet pills that suppress your appetite. And there are some that do contain natural vitamins and natural caffeine that may give you energy. But you need to understand what is in those pills so you know how other medications or foods will affect you.

The bottom line is to be healthy about weight loss. Do it with the guidance of a physician, health care provider or trainer. And eat healthy foods while you are dieting, don?t attempt to do it by taking a pill and then eating high calorie and high fatty foods and expect to loose weight. And move. Walk more, and sit less. It is a matter of health.

Edublog 2012 Award Nominations | Ctrl+Alt+Teach

Eddies 2012

As a newer blog on the educational block, this year is the first time I am submitting nominations for the 2012 Edublog Awards, a longterm community-based effort to recognize and promote the value of social media for educators and education. These awards truly are a way to give credit where credit is due as well as collect and share some of the best educational finds throughout the web all in an effort to improve the current state of education across the world. Personally, I am finding that just reading through the nominations themselves has led to finding amazing blogs, twitter chats, and social networks, among other things, that I have bookmarked and referenced frequently. One of my favorite blogs, Gridjumper?s Blog, is one such site I found through the Edublog Awards nomination listing. Now, I know, follow, and chat with her often, and I have learned so much about virtual words and machinima from her, enriching my own approach to education.

Don?t forget to nominate as well! Nominations are open until November 27th, 2012. ?

The following are my nominations for the Edublog 2012 Awards. I hope my readers might find something intriguing in this list as well!

Best individual blog

This amazing blog by Dr. Scott McLeod is the first blog I check on my Google Reader in the morning. That should say enough for this nomination (I write more about him and his blog below as well).

Best group blog

Hybrid Pedagogy is ?an academic and networked journal that combines the strands of critical and digital pedagogy to arrive at the best social and civil uses of technology and digital media in education.? Contributors come from a wide, interactive audience of all realms of education and embrace participation and social media in education. They hosted a mini-MOOC recently and established their own Twitter chat: #digped. The community is active and the ideas are emergent, exciting, research-based, and thought-provoking. Hybrid Pedagogy is not just a collaborative online journal but also a movement in the pursuit of professional and ?scholarly? blogging.

Best new blog

EdCamp Atlanta Unconference has its inaugural event this September, but they have been actively establishing an active and amazing blog on their website that includes posts from local educators as well as national figures in education. Ed Camp Atlanta takes pride in having a blog that makes their unconference more than just a one-day-and-nothing-more event. They use their blog as an outreach and networking resource for Atlanta-area educators and should be commended for their blogging activity.

Best ed tech / resource sharing blog

Gridjumper has been actively blogging and contributing to both the emergent topics of Game-Based Learning, Virtual Worlds in Education and Machinima to the point where her blog has become a leading authority in those topics. She is constantly sharing and contributing to the growing wealth of knowledge, especially at the helm of Machinima in education, and writes some of the most straight-forward and intriguing posts that anyone might find in an educational blog. The resources that she shares are indispensable?and very useful and her clear descriptions of easy to use albeit very emergent educational technology makes these topics palatable to even the most technology-resistant of educators.

Best administrator blog

This blog by Dr. Brett Jacobsen, Head of School for Mount Vernon Presbyterian School in Atlanta, Georgia, features his forward-thinking and open-minded leadership style as well as his emphasis on the emergent Design Thinking movement in education. He dedicated this blog and his work to the improvement of K-12 education by using new movements, thought-processes, and research and not being afraid to experiment. He advocates a ?fail up? mentality, embracing the fearlessness and illustrating himself that not being afraid of failure can mean amazing amounts of success in your endeavors.

Most influential blog post

Best individual tweeter

David Kapuler shares some of the most useful and interesting content on Twitter that I frequently read, reference, and retweet. I enjoy his recommendations for #FollowFriday, which is where I find some of the most interesting EduTweeps to follow and enjoy their content.

Best twitter hashtag

As the Game-Based Learning MOOC leaves its second iteration and goes possibly into its third iteration, the related #gamemooc hashtag and Wednesday night Tweet Chats are constantly going stronger and stronger. There is no other better hashtag, other than #gbl, that can give you the best information on games in education, MMORPGs, gamification, learning badges, virtual worlds, and so much more under the umbrella of Game-Based Learning. Also, the #gamemooc Wednesday TweetChat is in a league of its own, as there is no other TweetChat of which I am familiar that actively discusses and engages in debates regarding GBL.

Best free web tool

What better way to have free, multiuser F2F or audio only discussions, speakers, and presentations that also includes a live stream to YouTube with backchannel chat window for including larger audiences as well as Slideshare, screenshare, interactive Google Docs in the Hangout and much more? This is a SUPERB service that more educations need to use ASAP!

Best educational use of audio / video / visual /?podcast

EdReach is an amazingly comprehensive site featuring news and views on all points of education by the educators themselves. EdReach has ?channels? on which they host a multitude of podcasts as well as video both traditionally-recorded and Google+ Hangout on Air-recorded. The variance of perspective as well as the multiplatform usage of audio and visual is what makes EdReach extremely unique in the online social educational world, and I STRONGLY believe EdReach should receive credit for their hard work in corralling so many contributors and making their various presentation platforms function well! Not to mention that EdReach is also on web RADIO! How many educational group sites can claim that feature?

Best open PD / unconference / webinar series?

G.A.M.E. (Gamers Advancing Meaningful Education) broke ground with their multiplatform speaker series gathering experts in games and simulations in education to speak to a large audience interested in learning more and interacting with others interested in the topic. There is no other similar free development and networking opportunity that is hosted both using Google+ Hangouts on Air as well as with a backchannel in Second Life, YouTube chat, and Twitter chat.

Best educational use of a social network

I cannot possibly express this better than the website itself:

Gamers Advancing Meaningful Education (G.A.M.E) is an online community of global educators who game. At its core is an online synchronous gaming community. This intellectually curious network of educators develop curriculum, offer online open courses, webinars and F2F presentations on the opportunities and deeper learning that takes place in games.

G.A.M.E. is for educators who game, want to learn how to game, and want to incorporate gaming strategies into teaching and learning. Participants will become familiar with the use of massively online roleplaying games, commercial off-shelf games and sandbox genre games in their quest to innovate teaching and learning.

All educators are welcome, novice, dabbler, and hardcore gamer. Come game with us to level up on teaching and learning. It?s more than an affinity space for educators who game ? it?s a guild.

Best mobile app

I have been a fervent fan of Remind101 for quite some time. Their fast, secure, and safe SMS text messaging for teachers is so incredibly useful (and not just for reminders!), so when they came out with their iPhone app and later with their Android app, I jumped with joy. I use this app so frequently that I have it on my first page of app icons on my iPhone. They were able to take something complex and make the app so simple to use, even for first-time users and/or educators who struggle with new technologies. They are an remarkable educational startup who heard us teachers asking for an app and responded extremely quickly.

Lifetime achievement

Another nomination for the amazing blog by Dr. Scott McLeod. He really is one of THE most influential people in education today and has been for quite some time. He co-created the infamous ?Did You Know?? video series (aka ?Shift Happens) and constantly produces research as well as presents and keynotes. Meanwhile, he founded CASTLE (Center for the Advanced Study of Technology Leadership in Education) and his personal blog is incredibly riff with ideas and thoughts as well as information and motivation for those of us trying to make the change happen in education. If you are reading this list of nominations, I want to to walk away at the very least with this leader?s name and links to his work.

from your own site.
