Judge questions Obama's comments about courts

President Barack Obama's comments about the health care law touched off a debate, leading a federal judge to ask the Justice Department to refute what Obama said.

NBC News? Pete Williams reports on a controversy sparked by federal appeals court Judge Jerry Smith, who put a Justice Department lawyer on the spot Tuesday for remarks made by his boss, President Barack Obama.

Smith, a Ronald Reagan appointee to the 5th Circuit Court, questioned Obama?s response to a question regarding his predictions about whether the Supreme Court might strike down the health care law. The Supreme Court heard six hours of arguments about the law last week. ?

?For years what we heard was that the biggest problem on the bench was judicial activism, or lack of judicial restraint,? Obama said. ?An unelected group of people would overturn a duly constituted and passed law. This is a good example.?

Judge Smith asked for a letter from the government by noon Thursday stating its position on the power of the courts to strike down laws.

'Modern Warfare 3' players planning protest

Are you a fan of "Call of Duty: Modern?Warfare?3" who is angry and annoyed with a game that has yet to stack up? Well, save the date: April 20. That's when some players are organizing a blackout protest, aimed at Infinity Ward and Activision, the game's developer and publisher?respectively.

The following video, which surfaced last week and has been gathering steam ever since, illustrates the reasons why some "Modern Warfare 3" players are so angry, and why they are being asked to not touch the game for 24 hours later this month:

The list of grievances includes long-standing bugs that have yet to be fixed and features that have either been promised but not yet delivered, or are glaring omissions when compared with other first-person shooters on the market.

One major source of frustration has been the frequency in which Infinity Ward and Activision provides downloadable content for "Modern Warfare 3," along with its aggressive price structure, the?controversial?subscription based service known as "Call of Duty ELITE."

"ELITE" provides a wealth of DLC in a bundle for a discounted price of $50, but it's still considered steep, and practically the price of a new game. It also provides features that are only available for paid member, some of which is offered for free in other titles.

The core complaints stem from the contant updates, and thus the constant need to nickel and dime its customers,?while still ignoring issues with the core experience since day one.

As expected, many are wondering how effective such a protest will be. Other have also noticed the date itself, 4/20, which is often associated by some as the time of day they use marijuana. That's another reason some question if such an initiative should be taken seriously in the first place.

Express Scripts' $29.1B deal for Medco closes

NEW YORK (AP) ? Express Scripts Inc. said Monday that it completed its $29.1 billion acquisition of Medco Health Solutions Inc., creating the largest pharmacy benefits manager in the country by far.

The closing came after the Federal Trade Commission voted to close its investigation into the deal, clearing the last hurdle in its path. Express Scripts shares rose $2.29, or 4.3 percent, to $56.47 in premarket trading.

The deal creates a pharmacy benefits manager, or PBM, so large that it will handle the prescriptions of about 135 million people, or more than one in three Americans.

Both companies touted the savings and efficiency that the combination would create, while others in the industry have voiced concerns about competition.

Last week, an alliance of drugstores and community pharmacists filed a federal lawsuit to stop the deal from going through, saying it would create a giant pharmacy benefits manager with too much leverage and market share.

Express Scripts Chairman and CEO George Paz said the combination of the two companies will both lower costs and improve patient care.

Pharmacy benefits managers, or PBMs, run prescription drug plans for employers, government agencies and other clients, using their large purchasing power to negotiate lower drug prices. They make money by reducing costs for health plan sponsors and members.

In July, St. Louis-based Express Scripts said it would pay $28.80 in cash and a portion of an Express Scripts share valued at $42.56 for each share of Franklin Lakes, N.J.-based Medco.

Express Scripts said Monday that it still expects the acquisition to result in cost savings of $1 billion once the two companies are fully integrated. The company also still expects its earnings per share to increase slightly in the first year after closing and then moderately increase once the companies are fully combined.

Both companies become subsidiaries of Express Scripts Holding Co., which will trade on the Nasdaq stock exchange under the symbol "ESRX."

Express Scripts has also made news with its public split with Walgreen Co., the nation's largest drugstore chain. After a contract expired, Walgreen stopped filling prescriptions for Express Scripts, saying it would rather give up the revenue than continue filling unprofitable prescriptions.

Another friend of mine has been with her guy for almost 20 years (yes, they were just about infants when they started dating) and hasn?t ever passed gas in front of him. Unless something has changed since I last asked, that?s a whole lot of ?holding it in?.
